Ownership of Content
As between you and AineOne, you retain ownership of your Input, and we assign to you any rights we hold in the Output to the extent permitted by applicable law.
Similarity of Content
Due to the nature of AI, Outputs may not be unique, and other users may receive similar Outputs from the Services.
Our Use of Content
We may use your Content to maintain, improve, and develop our Services. You can opt out of your Content being used to train our AI models by updating your account settings.
Accuracy of Output
Artificial intelligence is a rapidly evolving field. While we strive to provide accurate and reliable Outputs, they may not always reflect real facts or be free of errors.
When using AineOne, you agree that:
- Outputs are not guaranteed to be accurate or complete.
- You must evaluate Outputs for suitability before relying on them, especially for decisions with legal or material consequences.
- AineOne is not responsible for any harm caused by reliance on inaccurate or inappropriate Outputs.
Our IP Rights
We own all rights to the technology, software, and trademarks associated with AineOne. You may only use our name and logo in compliance with our Brand Guidelines.
Paid Accounts
Billing
When purchasing AineOne Services, you must provide accurate billing information, including a valid payment method. Paid subscriptions automatically renew on a periodic basis until canceled. Taxes may apply based on your location, and we will charge tax when required. If your payment method fails, your account may be downgraded or suspended until payment is received.
Service Credits
Certain services can be prepaid through service credits, which are governed by our Service Credit Terms.
Cancellation
You may cancel your subscription at any time through your account settings. Payments are non-refundable except as required by law. Local laws governing your cancellation rights remain unaffected by these Terms.
Changes
AineOne reserves the right to adjust pricing. If subscription prices increase, you will be given at least 30 days' notice, and the new pricing will apply to the next renewal. If you do not agree to the changes, you may cancel your subscription.
Termination and Suspension
Termination
You may stop using AineOne Services at any time. We reserve the right to suspend or terminate your account under the following conditions:
- You violate these Terms or our Usage Policies.
- It is required to comply with legal obligations.
- Your use of the Services poses risks to AineOne, its users, or others.
- Your account remains inactive for over a year without an active paid subscription.
In such cases, we will make reasonable efforts to notify you before taking action.
Appeals
If you believe your account has been terminated or suspended in error, you may file an appeal through our Support team.
Discontinuation of Services
If AineOne decides to discontinue any Services, we will provide advance notice and offer refunds for any unused prepaid portions.
Disclaimer of Warranties
The AineOne Services are provided “as is” and without warranties of any kind, to the maximum extent permitted by law. We disclaim all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
You agree to use Outputs from AineOne at your own risk and to verify the appropriateness and accuracy for your specific needs. AineOne is not liable for errors, interruptions, or inaccuracies in the Services.
Limitation of Liability
To the fullest extent permitted by law, AineOne and its affiliates are not liable for:
- Indirect, incidental, or consequential damages, including loss of profits, goodwill, or data.
- Total liability exceeding the amount you paid for the Services in the 12 months prior to the claim or $100, whichever is greater.
Some jurisdictions do not allow the exclusion of certain damages. In those cases, these Terms apply only to the extent permitted by local laws.
Indemnity
If you are using AineOne Services for business purposes, you agree to indemnify and hold harmless AineOne, its affiliates, and personnel from any claims, liabilities, or damages arising from your use of the Services.
Dispute Resolution
Mandatory Arbitration
By using AineOne Services, you agree to resolve disputes through binding arbitration instead of court proceedings. Exceptions include:
- Individual claims in small claims court.
- Equitable relief for unauthorized use of intellectual property.
Class Action Waiver
You waive the right to participate in class actions or group lawsuits. All claims must be resolved individually.
Opt-Out
You may opt out of arbitration within 30 days of account creation or updates to arbitration terms by contacting us via support.
Batch Arbitration
If multiple similar claims arise, arbitration may be consolidated into batches, where appropriate, to streamline the process.
